What type of custody is best for your situation?

Whether you are currently going through a divorce or you are considering filing papers, there are a myriad of issues to tackle. If there are children involved in your situation, the process becomes more complicated, as you must determine what type of living arrangement is best for your kids. The judge presiding over your case will often look at several factors before deciding whether to award sole-physical custody to one parent or choose a joint-physical custody living arrangement. Before making this crucial decision, however, there are several factors to consider.

The judge may first look at the occupation of each parent, as well as how much time the parent has to care for the child. Furthermore, it may be beneficial to keep the child with the parent who acted as the primary caretaker during the marriage. Other factors to consider may include the following:

  •          What school would the child attend?
  •          How safe is the neighborhood the child would live in?
  •          How far away do the parents live from one another?

Although sole-physical custody allows the child to reside primarily in one house and keeps the child from having to move back and forth between parents, studies show the benefits of joint-custody arrangements as well. When children have consistent access to both parents, they tend to fair better in life. Joint-custody may be better suited for children who are not in school yet and other arrangement can be made.
