COBRA benefits following your divorce

Those first few days, weeks and even months following your divorce in Roswell can be the most difficult to get through. Even if the circumstances of your separation from your spouse make your new situation a welcome relief, adjusting to life without their support can be hard (particularly if you were not the primary income earner in your marital home). One of the aspects of post-divorce life that many of those who come to see us here at the Sanders Law Firm find most difficult to adjust to is the uncertainty that they feel over seeking costly assistance that they received previously from their ex-spouses (such as health care). 

If you share the same concern heading into your divorce proceedings, you should know that you will not necessarily be left without healthcare coverage if you are unable to immediately secure gainful employment. The Consolidated Omnibus Budget Reconciliation Act was created to help people in your exact situation. 

Per the U.S. Department of Labor, one of the primary purposes of COBRA is to extend employer-sponsored benefits like group health plan coverage to those who may not currently have access to them due to a loss of association with a sponsoring entity. In this case, the loss comes from your separation from your spouse (who likely held health insurance for your entire family through their employer). 

If the organization that sponsors your ex-spouse’s health plan is a private company that employs more than 20 people (or is a state or local agency), and you were eligible for coverage the day prior to your divorce being finalized, then COBRA allows you to remain on your ex-spouse’s health insurance plan for up to 36 months.
