What type of benefits does workers' compensation offer?

If you are employed in the state of New Mexico, it is important for you to know how this state approaches workers' compensation benefits. Every state has its own program designed to help employees who develop illnesses or experience injuries related to their job environments or the execution of their job responsibilities. If you are one of these people, you may qualify for financial assistance through the workers' compensation program.

As explained by the State of New Mexico Workers' Compensation Administration, if you are unable to work due to your illness or injury, you may be able to apply for disability workers' compensation benefits. There are three types of these benefits depending on the extent and duration of your disability. If your disability prevents you from working in your original role but allows you to work in a limited capacity earning less than you normally did, you may apply for temporary partial disability benefits. These pay a portion of the difference between your normal pay and the adjusted work pay.

If you are not able to work at all, you may apply for total disability benefits. These may be temporary or permanent depending on whether you have been identified as medically able to improve further or not.

This information is not intended to provide legal advice but is instead meant to give residents in New Mexico an overview of the types of benefits they may be eligible for under the state's workers' compensation program if they ever become injured on the job.
