Why divorce filings increase in January

New Mexico couples who are considering ending their marriages may decide that they want to wait until after the holidays and file in January. They might do this because they want their children to have one last holiday in which the family is together.

In other situations, it is the stress and togetherness of the holidays that makes people realize that they are ready for a divorce. They decide they do not want to go through another holiday with the person they are married to. A new year is also a time for fresh starts, and some people may look on the divorce in that way.

Two things can make the divorce process less difficult. One is researching and learning more about it. The other is resolving to try to be considerate to one another. This can be particularly important for parents because they will need to build a functioning co-parenting relationship after the marriage is over.

An attorney can help clients understand their rights and answer any legal questions about the divorce. Not every couple must go through litigation to reach an agreement on property division and child custody. Negotiating an agreement outside of court can help couples create more flexible arrangements that suit them. For example, since New Mexico is a community property state, all shared property is supposed to be split equally. This could mean the couple dividing all their property or the proceeds from the sale of property 50/50, but some couples take a different approach. One person might keep the home while the other keeps a retirement account that has a similar value.
